A Right to Marry? Same-sex Marriage and Constitutional Law - Arranged Gay Marriage

NRI Sets Up India's 1st Gay Marriage Bureau

The general belief is that most homosexuals tend to identify their own partners and settle with them. But Benhur Samson, who used to help gays with surrogacy in India till 2013, was surprised when he received requests from them regarding prospective life partners.

"Several people wanting an arranged marriage were looking for partners from India. The reason seems to that arranged marriages are common in India. Also, Indians are known for their commitment, their loyalty to partners and hard-working nature," said Samson. He added that issues like drug abuse were also less common among Indians.

The fatwa stated that a female-born transgender person having "visible signs of being a male" may marry a woman or a male-born transgender with "visible signs of being a female”, and vice versa.

However, it ruled that a transgender person carrying "visible signs of both genders" - or intersex - may not marry anyone.

It is currently impossible for transgenders to marry in Pakistan, where gay marriage remains punishable by life imprisonment, and no “third gender” is recognized on official identity cards.

The new fatwa also declared that any act intended to "humiliate, insult or tease" the community was “haraam” (sinful), and that transgender persons should not be deprived of family inheritances, nor the right to be buried in Muslim ceremonies.

A matrimony website for homosexuals - Arranged Gay Marriage

Benhur Samson, an NRI settled in the US has started a matrimony website for homosexuals to find their life partners in India.
He works in the field of medical tourism and helps gay couples have children through surrogacy. He decided to start the service arrangegaymarriage.com for homosexuals to get life partners after requests from his clients, after, Obama declared marriage equality rights.
His website has already got about 250 requests from gays, mostly Indians, and the agency has helped around 29 couples to get married till now.
The idea of the website came up because of the several of his gay clients, who were opting for surrogacy services, were visiting India to get their babies where they’d find partners and would like to stay together. After the clients get enrolled, the portal gives them a one year time and promises them to find them a suitable partner within that time frame.
